Cannabis in Minnesota
To date, 24 states and the District of Colombia have legalized marijuana for adult recreational use. Minnesota's landmark legislation legalizing recreational cannabis (Laws of Minnesota 2023, chap. 63) was signed by Governor Tim Walz on May 30, 2023. The new law authorizes the possession, consumption, and sale of cannabis for adults 21 and over, and establishes a regulatory framework for these products under the newly created Office of Cannabis Management. The new law also continues to make provision for the use and sale of lower-dose cannabis and hemp products, which began to proliferate in Minnesota following changes made by the Legislature in 2022. Recreational marijuana dispensaries are not expected to open until 2024 or 2025. Tribal governments in Minnesota can craft their own cannabis policies, and some have already opened dispensaries.
The Library recently added the 2023-2024 edition of the Cannabis Law Deskbook from the Attorney General Alliance. Contributing authors are experienced public sector attorneys and regulators from over a dozen state and local jurisdictions across the country who are subject-matter experts in cannabis law and policy. The deskbook addresses areas of cannabis law and policy most relevant to those readers interested in this dynamic field of law. This reference book is available for short-term loan.
We also received an updated House Research publication: Minnesota’s Medical Cannabis Program, October 2023. And Minnesota's Legislative Budget Office (LBO) published Local Impact Note Request: HF 100 (Stephenson)/SF 73 (Port) - Legalize Adult-Use Cannabis, October 13, 2023. The LBO surveyed local units of government across Minnesota to gather information about the fiscal impact after legalization and received a total of 68 individual responses from cities and counties.
