Family Preservation and Foster Care in Minnesota
Minnesota legislators passed the African American Family Preservation and Child Welfare Disproportionality Act with bipartisan support in 2024 (Laws of Minn. 2024, chap. 117). The Act requires social service agencies to make "active efforts to prevent the out-of-home placement" of African American or disproportionately represented children, and to work to reunify children with their families "as soon as practicable." A working group tasked with helping prepare for statewide implementation of the act issued an interim report in January 2026.
Hennepin and Ramsey counties established pilot programs under the act in 2025 and received specific appropriations for that work. As reported during the 2026 legislative session, other Minnesota counties are generally supportive of the act, but told state lawmakers that they need more financial support to implement the act’s final provisions by the January 2027 launch date. Some changes were made to the African American Family Preservation Act this year (Laws of Minn. 2026, chap. 127, art. 11), and that law also appropriated $15 million to aid counties as they implement this act statewide.
