Respiratory Care Advisory Council

Function: Advise the Minnesota Board of Medical Practice on the regulation of respiratory care practitioners in areas such as standards, licensure, handling of complaints and discipline, and continuing education. (2011)

History: On October 14, 1991 (16 SR 958) the Minnesota Department of Health in accordance with Minnesota Statutes 214.13 Subd. 4 adopted Minnesota Rules Ch. 4762 (1993) that created this advisory council. The 1994 Annual Compilation and Statistical Report states that it expired on June 30, 1994 in accordance with Minnesota Statutes 15.059, Subd. 5. The legislature reinstated them effective April 21, 1995 (1995 Laws of Minnesota, Ch. 43). In 1997 the Rules were repealed by the legislature and replaced with statutory authority (1997 Laws of Minnesota Ch. 120, Sec. 9. This change became effective on August 1, 1997. In 2009, practitioner was dropped from their name with the passage of 2009 Laws of Minnesota Chap. 142, Art. 2, Sec. 1. (2011)

The Respiratory Care Advisory Council was reviewed by the Legislative Commission on Planning and Fiscal Policy (LCPFP) in 2013 as part of their biennial duty required by Minn. Stat. 3.885 Subd. 11. The LCPFP's 2013 Recommendations called for keeping the council.
Membership: 7 members; 2 public members as defined in Minnesota Statutes 214.02, 3 licensed respiratory therapists, and 2 licensed physicians with expertise in respiratory care; appointed by the Board of Medical Practice, four year terms. Meetings are held on a bimonthly basis. The advisory council is organized and administered under Minnesota Statutes 15.059. (2011)
