Out with the old...
Annual Report on Obsolete, Unnecessary, or Duplicative Rules. The title probably doesn't conjure up anticipatory images of curling up in a comfy chair, a mug of steaming hot chocolate at hand, lost in a good book. Yet, every December, these reports flow into the Legislative Library – 31 of them so far this year.
While the reports might not make riveting reading, they serve an important purpose: keeping Minnesota's Administrative Rules up-to-date and relevant. The annual reviews are mandated by Minnesota Statutes § 14.05, subd. 5 and are required of state departments, agencies, boards, and regulatory groups that has been given rulemaking authority by the Minnesota Legislature. They are often brief, the full report consisting of a one-sentence statement that there are currently no obsolete, unnecessary, or duplicative rules, such as this year's report from the Office of Administrative Hearings. But there are usually a few which provide recommendations for change, including recent reports from the Department of Natural Resources and the Department of Revenue. You can view a list of all obsolete rules reports received by the library since the mid-1990s and can create customized lists by agency and by year.
These reports are just a small component of the administrative rule making process, a process that is sometimes not well-known or understood. The Revisor of Statute's webpage, "Minnesota Administrative Rules", provides an introductory explanation and links to a variety of resources related to the overall process. Among the resources is a Rule Status System that can be used to track the history of a particular rule, rules on a particular issue, or rulemaking by a specific agency.
