Formulary Committee

Function:

Duties include reviewing prescription and selected over-the-counter drugs and making recommendations about prior authorization. The committee also establishes the list of drugs excluded from mandatory generic substitution under MS 151.21.

History:

The Formulary Committee was reviewed by the Legislative Commission on Planning and Fiscal Policy (LCPFP) in 2013 as part of their biennial duty required by Minn. Stat. 3.885 Subd. 11. The LCPFP's 2013 Recommendations called for keeping the committee.

2018 Minn. Laws Chap. 164 Sec. 2 extended the committee's expiration date from June 30, 2018, which had been set in 2014, to June 30, 2022. The committee's expiration was further extended to June 30, 2023 by 2021 Minn. Laws 1st Sp. Sess. Chap. 7, Art. 1, Sec. 9.

That same law directed the commissioner of Human Services to submit an overview of the Formulary Committee to the Legislature that includes "a review of the current composition" and a "summary of the committee's policies and procedures" (see Sec. 35)

2023 Minn. Laws Chap. 70 Art. 1 Sec. 13 increased membership of the Formulary Committee from four members to at least five licensed physicians actively engaged in the practice of medicine in Minnesota, one of whom is an actively practicing psychiatrist, one of whom specializes in the diagnosis and treatment of rare diseases, one of whom specializes in pediatrics, and one of whom actively treats persons with disabilities; at least three licensed pharmacists actively engaged in the practice of pharmacy in Minnesota, one of whom practices outside the metropolitan counties listed in section 473.121, subdivision 4, one of whom practices in the metropolitan counties listed in section 473.121, subdivision 4, and one of whom is a practicing hospital pharmacist; and one at least two consumer representative representatives, all of whom must have a personal or professional connection to medical assistance; and one representative designated by the Minnesota Rare Disease Advisory Council; the remainder to be made up of health care professionals who are licensed in their field and have recognized knowledge in the clinically appropriate prescribing, dispensing, and monitoring of covered outpatient drugs.
