Sunset Advisory Commission
Active dates:2011-2013
Function: Before January 1 of the year in which a state agency subject to this chapter and its advisory committees are subject to sunset review, the commission shall:
(1) review and take action necessary to verify the reports submitted by the agency; and
(2) conduct a review of the agency based on the criteria provided in section 3D.10 and prepare a written report.
By February 1 of each even-numbered year, the commission shall present to the legislature and the governor a report on the agencies and advisory committees reviewed. In the report the commission shall include:
(1) its findings regarding the criteria prescribed by section 3D.10;
(2) its recommendations based on the matters prescribed by section 3D.11; and
(3) other information the commission considers necessary for a complete review of the agency.
History:

In its Findings and Recommendations report issued on January 31, 2012, the Minnesota Sunset Advisory Commission requested that the Minnesota Department of Administration (Admin) and the Office of Legislative Auditor (OLA) "conduct a program and financial review [on the Combative Sports Commission] and report on the feasibility of a merger with the Amateur Sports Commission, forming a Minnesota Sports Commission that includes functions of both entities."
2012 Minn. Laws, Chapter 278, made several changes to the sunset review process and abolished the Combative Sports Commission. Duties of the commission are transferred to the commissioner of labor and industry who is directed to appoint a Combative Sports Advisory Council to advise the commissioner on the administration of duties under this chapter.
2013 Minn. Laws, Chapter 142 (SF1589, Omnibus State Government bill), repealed the Sunset Advisory Commission. Article 2, Section 1 permits the Legislative Commission on Planning and Fiscal Policy to review executive branch advisory groups on criteria similar to those applied by the Sunset Commission.
Membership:
The Sunset Advisory Commission consists of 12 members appointed as follows:
(1) four senators, appointed according to the rules of the senate, with no more than three senators from the majority caucus;
(2) four members of the house of representatives, appointed by the speaker of the house, with no more than three of the house of representatives members from the majority caucus; and
(3) four members appointed by the governor.
