History:
The Occupational Safety and Health Review Board, established in 1973 as the Occupational Safety and Health Review Commission (Laws of Minnesota 1973, chapter 732, section 15), began work in February of 1974. The commission became the Occupational Safety and Health Review Board in 1975 (Laws of Minn. 1975, chap. 271, sec. 6). The board reviews contested citations and monetary penalties issued under the Occupational Safety and Health Act of 1973, and all final orders of the commissioner of labor and industry in contested cases. Any employer, employee, or employee representative may contest an OSHA citation by notifying the commissioner within fifteen days of receiving the citation. The board may affirm, modify, or revoke a citation, penalty, or contested order. The board consists of three members, representing management, labor, and the general public, who are appointed by the governor for four-year terms. Although the board is listed as part of the Occupational Safety and Health Division of the Labor and Industry Department in legislative manuals and directories, it is referred to as an independent, quasi-judicial body in the department's biennial reports.
